Personal Injury Case Results

• Plaintiff: Infant pedestrian struck by a commercial delivery truck and suffered permanent brain damage.  Although the defense claimed it was a “dart-out” case,  the attorney for the Plaintiff proved the truck was at fault for accident.  Mr. Palermo utilized an expert accident reconstruction team to demonstrate his case.  Case Result: After answering the Defendant’s Motion to Dismiss and entering a Cross Motion for a unified trial, the Plaintiff’s attorney negotiated a settlement of $3,205,000.
• Plaintiff: Woman was held captive, raped and brutally beaten by a convicted felon who was released from prison mistakenly, due to an error made by the state.  Case Result: After trial, Plaintiff awarded $1,950,000 verdict. This case marked the first time that the State of New York was held liable for injuries caused by a felon who was released from prison in error.
• Plaintiff: Severely and permanently injured in a motor vehicle accident.  The driver of the vehicle was insured for only $250,000.  The damages to the client far exceeded that amount. Case Result: After a thorough investigation, Mr. Palermo was able to obtain an additional $725,000 for his client because the driver had leased the vehicle from a leasing company. Mr. Palermo obtained the additional $750,000 from the leasing company.  The client received a combined settlement of $975,000.
• Plaintiff: Operator of a motor vehicle that was hit by a truck that made an illegal left-hand turn.  Client suffered multiple injuries including a fractured toe and torn ligament of the right ankle.  Case Result: Client received a settlement of $275,000.
• Plaintiff: A 69-year-old man with prior degenerative back problems was a passenger in a motor vehicle that was rear-ended by a truck while on vacation in Florida.  Due to the accident, client underwent back surgery for cervical herniations in which interbody prosthesis and instrumentation was inserted at each disc level.  Case Result: Settlement of $350,000.
• Plaintiff: Operator of a motor vehicle that was rear-ended by a truck.  Client suffered multiple injuries including lumbar herniations at several levels. Due to the accident, the client was forced to undergo back surgery (lumbarSemi-hemilaminectomy and microdiskectomy) to remove the damaged discs. Case Result: Settlement of $350,000.
• Plaintiff: A 62-year-old woman on social security/disability for a prior neck injury was struck by a motor vehicle that disobeyed a red traffic light.  Due to the accident the plaintiff’s neck injury worsened.  The client was forced to endure a cervical spinal fusion, a surgery in which a rod was placed in her neck.  Case Result: Client received a settlement of $612,000.00.
